Pick your plan, tell us who you are, then read and sign the one-page agreement below. Nothing is charged until Troy confirms your order with you.
This Agreement is made between LUCKY DUCK PRODUCTIONS LLC, an Oregon limited liability company ("Lucky Duck"), publisher of KlamathLiving.com, and the business named on this form ("Sponsor"), as of the date signed. "The Game" means Klamath Living Craft World, the online game Lucky Duck builds and runs. Sponsor's choices on this form (plan, term, town and add-on) are part of this Agreement. The Game's world is the Klamath Basin; businesses in Klamath Falls and in Eagle Point both appear in it.
1.1 Magazine Sponsor Billboard. If Sponsor has a Klamath Living or Eagle Point Living magazine agreement running, Sponsor gets a billboard in the Game showing Sponsor's latest magazine ad, at no charge, for as long as that magazine agreement runs. If Sponsor has no finished magazine ad, Lucky Duck makes the billboard design.
1.2 Basic Digital Plan. For a business that is not a magazine sponsor: a billboard in the Game; an ad on KlamathLiving.com and on Sponsor's town's Oregon Living site (KlamathFalls.OregonLiving.net or EaglePoint.OregonLiving.net); and a basic website built and hosted by Lucky Duck. Lucky Duck designs Sponsor's ad, using its own tools (which may include AI tools) and resources, from Sponsor's logo, photos and message.
1.3 Ad design changes. The setup includes one ad design. After that, Sponsor gets one free redesign each calendar quarter. Any further redesign inside the same quarter is $99.
1.4 Building and Character add-on. Sponsor's own building and Game character, $99 one-time setup. For a magazine sponsor it stays at no further charge while the magazine agreement runs. On the Basic Digital Plan it requires a 12-month term.
2.1 Basic Digital Plan: $99 per month, billed monthly in advance. Setup fee $399. The setup fee is waived when Sponsor signs a 12-month term before the Game's official public launch (planned for December 2026). Month to month is available with the $399 setup fee.
2.2 Building and Character add-on: $99 one-time. Extra ad redesign inside a quarter: $99 each.
2.3 Helpers Lucky Duck names in writing who build and test the Game with Lucky Duck pay no setup fees.
2.4 After Sponsor signs, Troy Miller reviews and confirms the order with Sponsor. Lucky Duck then bills through its accounting system (QuickBooks Online) by recurring invoice, with card or bank (ACH) autopay. Nothing is charged before that confirmation. Prices do not include any sales tax that may apply.
2.5 If a payment is more than 10 days late, Lucky Duck may pause Sponsor's billboard, ads, building and character until the account is current. A pause does not extend the term.
3.1 12-month term: runs 12 months from the date Sponsor's billboard first appears in the Game, then continues month to month until either party cancels. If Sponsor cancels before the 12 months end, the waived $399 setup fee becomes due and no further monthly fees are charged.
3.2 Month to month: either party may cancel with 30 days' written notice; email counts.
3.3 Magazine sponsors: the billboard, and the building and character, stay for as long as the magazine agreement runs. When it ends they come down, unless Sponsor moves to the Basic Digital Plan.
3.4 If the Game's public launch moves past January 31, 2027, Sponsor may cancel with nothing further due, and any setup fee paid is refunded.
3.5 Lucky Duck may end this Agreement with 30 days' written notice, or at once if Sponsor breaks section 5 or 6. Fees already paid for time not yet served are refunded, except where Sponsor broke section 5 or 6.
The basic website is free while the Basic Digital Plan is active. If the plan ends, Sponsor keeps the text and photos Sponsor supplied, and Lucky Duck offers paid hosting.
5.1 Sponsor supplies or approves its ad, its building's look, its character's look and its character's words. Lucky Duck sends a proof. A proof is approved when Sponsor approves it, or 5 business days after it was sent if Sponsor has not asked for a change.
5.2 The Game is a family game played by children and adults. Every ad and every word in the Game must be suitable for all ages, truthful, and lawful. No ad may ask players for personal information, offer alcohol, tobacco, cannabis, firearms, gambling or adult products to players, or link to a page that does.
5.3 Lucky Duck may decline, edit for fit, pause or remove any ad or content at any time, at its sole discretion, including anything it believes breaks these rules, the law, or a third party's rights. Lucky Duck will tell Sponsor why.
5.4 Lucky Duck decides where billboards, buildings and characters go in the Game and may move them. Lucky Duck may change the Game's map, features, rules and platform at any time.
6.1 Sponsor confirms it owns or has permission to use every name, logo, image, product claim and word it supplies, and grants Lucky Duck a non-exclusive, royalty-free licence to show them in the Game, on KlamathLiving.com, on the Oregon Living sites, and in screenshots and video of the Game, for the term and for archive copies made during it.
6.2 A business that belongs to a corporation, chain or franchise appears in the Game only with the brand owner's written permission. Sponsor provides that permission before anything goes live.
6.3 Lucky Duck Productions LLC owns the Game, its world, its characters' designs, its software and the ad designs it makes (Sponsor may use its own ad design in its own marketing). Sponsor owns its own names, logos and supplied material.
7.1 Lucky Duck does not guarantee any number of players, views, clicks, visits, leads, sales or other results, any placement or position, or that the Game, the websites or any ad will be available at any particular time or without interruption, error or delay. Counts of views and clicks are Lucky Duck's own measurements and are provided for information only.
7.2 The Game is in private testing and may change, pause or end. If Lucky Duck stops running the Game, Sponsor's only remedy is a refund of fees paid for time not yet served.
8.1 Out of an over-abundance of caution: THE GAME, THE WEBSITES, THE ADS AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, LUCKY DUCK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ANY WARRANTY OF RESULTS.
8.2 NEITHER PARTY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL. LUCKY DUCK'S TOTAL LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE FEES SPONSOR PAID IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
8.3 Sponsor will defend, indemnify and hold harmless Lucky Duck, its owners and contractors against any claim, loss or cost (including reasonable attorney fees) arising from Sponsor's ads, content, products, services or claims, or from Sponsor breaking this Agreement.
8.4 Neither party is responsible for delay or failure caused by events beyond its reasonable control (for example outages, fires, storms, government action or the failure of a hosting or internet provider).
9.1 Oregon law governs this Agreement; any dispute is heard in Klamath County, Oregon. The party that wins a suit to enforce this Agreement or collect sums due may recover its reasonable costs and attorney fees.
9.2 This is the whole agreement about the Game and changes nothing in any magazine agreement. Lucky Duck may update these terms for future terms or renewals with 30 days' notice. If any part is unenforceable, the rest stays in force. Sponsor may not assign this Agreement without Lucky Duck's written consent. Notices go by email to the addresses on this form and to troymiller@luckyduckproductionsllc.com.
9.3 Nothing in this Agreement is legal, tax or financial advice to Sponsor.
ACCEPTED AND APPROVED. Sponsor's typed full legal name below constitutes Sponsor's signature on behalf of the business named on this form, and confirms the signer is authorised to sign for it.
